Tyler A. Stephens Plaintiff, v. The Estate of George W. Newell, Deceased; John Doe and Jane Doe, Richard Roe and Mary Roe, as Representatives of All Heirs and Devisees of the Estate of George W. Newell and All Persons Entitled to Claim Under or Through Them; Also, All Other Persons or Corporations Unknown Claiming any Right, Title, or Interest in or Lien Upon the Real Estate Described Herein, and Unknown Adults Being as a Class Designated as John Doe and Jane Doe, And Any Unknown Infants or Person Under Disability or Persons in Military Service Designated as a Class Richard Roe and Mary Roe; Defendants.

TO THE DEFENDANTS ABOVE NAMED:

YOU ARE HEREBY SUMMONED and required to answer the COMPLAINT in this action, a copy of which is attached hereto and herewith served upon you or filed with the Pickens County Clerk of Court, and to serve a copy of your Answer to the Complaint upon the subscriber at 133 Straight Drive, Anderson, SC 29625, within thirty (30) days after the service thereof, exclusive of the day of such service, except that the United States of America, if named, shall have sixty (60) days to answer after the service hereof, exclusive of the day of such service. If you fail to answer the Complaint within this thirty (30) day period, the Plaintiff will apply to the Court for the relief demanded in the Complaint and judgment will be taken against you by default.

YOU WILL ALSO TAKE NOTICE that Plaintiff will move for an Order of Reference or that the Court may issue a general order of reference in this action to a master in equity/special referee, pursuant to Rule 53 of the South Carolina Rules of Civil Procedure, and that pursuant to S.C. code Ann. §14-11-110, as amended, Plaintiff’s attorney will submit written testimony on behalf of the Plaintiff at said reference hearing.

IN THE EVENT YOU ARE AN INFANT OVER FOURTEEN YEARS OF AGE OR AN IMPRISONED PERSON, you are further summoned and notified to apply for the appointment of a Guardian ad Litem to represent you in this action within thirty (30) days after the service of this Summons and Notice upon you. If you fail to do so, application for such appointment will be made by the Plaintiff herein.

IN THE EVENT YOU ARE AN INFANT UNDER FOURTEEN YEARS OF AGE OR ARE INCOMPETENT OR INSANE, then you and the Guardian or Committee are further summoned and notified to apply for the appointment of a Guardian ad Litem to represent said infant under fourteen years of age or said incompetent or insane person within thirty (30) day after the service of this Summons and Notice upon you. If you fail to do so, application for such appointment will be made by the Plaintiff herein.
