YOU ARE HEREBY SUMMONED and required to answer the Complaint for Non-Emergency Removal for the minor child in this action filed against you, the original of which has been filed in the Office of the Clerk of Court for Pickens County on September 26th, 2018, copies of which will be delivered to you upon your request, and to serve a copy of your Answer to said Complaint upon the undersigned attorney for the Plaintiff to Julie M. Rau, Pickens County Department of Social Services, P.O. Box 158, Pickens, S.C. 29671 within thirty (30) days following the date of service upon you, exclusive of the date of service, and if you fail to answer said Complaint within the time stated, Plaintiff will apply for a Judgment by Default against you for the relief demanded in the Complaint.

SPECIAL REFEREE’S SALE

CASE NO. 2018-CP-39-00860

BY VIRTUE of a decree heretofore granted in the case of Branch Banking and Trust Company against Charles H. Nichols and Ann S. Nichols, I, the Special Referee for Pickens County, will sell on Monday, January 7, 2019, at 11:00 o’clock a.m., at the Pickens County Courthouse, Pickens, South Carolina, to the highest bidder:

All those certain pieces, parcels or lots of land, lying and being situate in the County of Pickens, State of South Carolina, designated as Tract A, containing 1.19 acres and Tract B, containing 1.26 acres as shown on a plat prepared for Charles H. Nichols by John F. Tinsley, P.L.S., dated December 12, 2011 and recorded in the Office of the ROD for Pickens County in Book 596 at Page 336 on December 16, 2011. Said plat is incorporated herein by reference for a more complete and accurate description.

This being the same property conveyed to Charles H. Nichols by deed of W. Brinkley Melvin dated December 22, 2011 and recorded in the Office of the ROD for Pickens County in Book 1462 at Page 241 on June 26, 2012.

TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee for Pickens County at conclusion of the bidding, five percent (5%) of the bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of non-compliance. If the Plaintiff’s representative is not in attendance at the scheduled time of the sale, the sale shall be canceled and the property sold on some subsequent sales day after due advertisement. Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, the deposit shall be forfeited and the Special Referee for Pickens County may re-sell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder). As a deficiency judgment is being waived, the bidding will not remain open thirty days after the date of sale. Purchaser shall pay for preparation of deed, documentary stamps on the deed, and recording of the deed. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the rate of 7.65% per annum. The sale shall be subject to assessments, Pickens County taxes, easements, easements and restrictions of record, and other senior encumbrances.

PUBLIC HEARING NOTICE

NOTICE IS HEREBY GIVEN that the County Council of Pickens County, South Carolina (the “County Council”), the governing body of Pickens County, South Carolina (the “County”) will conduct a public hearing on the proposed enactment of an ordinance entitled, “AN ORDINANCE AUTHORIZING THE CONVEYANCE OF THE GEORGES CREEK/CRAYTON CREEK SEWER INFRASTRUCTURE AND ALLOCATED CAPACITY, TO THE COMMISSION OF PUBLIC WORKS, CITY OF EASLEY, SOUTH CAROLINA; AND OTHER MATTERS RELATED THERETO.” (the “Ordinance”) on January 14, 2019 at 6:30 p.m., in the County Council chambers, which are located at Pickens County Administration Facility, 222 McDaniel Avenue, Pickens, South Carolina 29671.

All interested persons will be given an opportunity to be heard and express their views at the public hearing. A copy of the Ordinance is available for review at the County’s administrative facility during normal business hours.
