NOTICE OF SALE

By virtue of an Order of Foreclosure in the Court of Common Pleas for Pickens County, South Carolina, granted in the case of Pickens Savings & Loan Association, F.A. vs. Estates of Betty Joyce Sanders and Walter D. Sanders, et al., Daniel E. Hunt, Special Referee for Pickens County will sell on March 5, 2018 at 11 o’clock a.m. at the Pickens County Courthouse, Pickens, South Carolina, to the highest bidder, the following described property, to-wit:

ALL that piece, parcel or lot of land situate, lying and being in the State of South Carolina, County of Pickens, being shown and designated as containing 174,287.33 sq. ft., 4.00 acres, according to plat prepared by W. R. Williams, Jr., Surveyor, dated September 3, 1997 and recorded in Plat Book 282, at page 4-B, in the R/D Office for Pickens County, South Carolina, reference to said plat is being hereby made for a more complete metes and bounds description thereof.

AND ALSO: All that certain piece, parcel or tract of land situate, lying and being in the State of South Carolina, County of Pickens, about 11 miles northeast of Pickens, containing 1.4 acres, more or less, according to plat prepared by T. For derivation of title, see conveyance from Roger K. Johnston and Emily N. Johnston, a/k/a Emily M. Johnston to Walter D. Sanders and Betty Joy Sanders by deed dated April 25, 2008 and recorded May 1, 2008 in Deed Book 1182 at Page 118 in the Register of Deeds Office for Pickens County, SC.

See also Deed of Distribution from the Estate of Betty Joyce Sanders to Walter D. Sanders, Cindy King, Richard King, and Catherine Childers, said deed being dated July 21, 2016 and recorded same date in Deed Book 1786 at Page 307.

TERMS OF SALE: CASH to the highest bidder, other than Plaintiff, with 5% of the successful bid due in cash or certified check as a deposit at the conclusion of the sale. The successful bidder shall comply with his bid within twenty (20) days after the sale or the deposit shall be forfeited, applied to costs first and Plaintiff’s attorney fee next, and the property shall be resold at a subsequent Sales Day at the risk of the defaulting bidder. The Purchaser shall pay any current or delinquent property taxes thereon and the cost of the deed, stamps and recording. Deficiency judgment being waived, the bidding will close on the Sales Day.

If Plaintiff or its representative does not appear at the Sale, then the sale shall be postponed. The foreclosure deed is not a warranty deed. Neither Plaintiff nor its attorney make any representations to third parties as to the status of the title to the property. Prospective purchasers should consult an attorney and examine the title to the property being sold.
