“ALL that certain piece, parcel or lot of land situate, lying and being in the State of South Carolina, County of Pickens, located approximately one mile from the Town of Six Mile, and being know and designated as Lot No. 15 of ISAQUEENA FARMS SUBDIVISION, according to a plat thereof prepared by R. J. Cooper, P. E. & L. S. 4682, dated December 16, 1976, recorded in Plat Book 23 at page 181, records of Pickens County, South Carolina, and having according to said plat the following metes and bounds, to-wit:

PERSONALLY appeared before me, the undersigned Notary Public for South Carolina, Perry H. Gravely, who, being duly sworn, made oath that he is the Attorney for the Plaintiff; that this is an action whereby the Plaintiff seeks a declaration from the Court that he is the lawful and fee simple owner of real property in Pickens County by virtue of Delinquent Tax Sale held October 4, 2004 and seeks an Order directing the Clerk of Court for Pickens County to execute a deed to him regarding said property; that the whereabouts of certain Defendant are unknown and that some Defendants are unknown; that due diligence and efforts have been made to locate said Defendant but to no avail; that said Defendant, known and unknown, claim or may claim an interest in the property located in the County of Pickens, State of South Carolina, said property being the subject of this action, and said property being subject to the jurisdiction of this Court; that your Deponent is informed and believes this is an action in which service may be had upon said unknown Defendant and said Defendant whose whereabouts are unknown by  publication as provided by South Carolina Code Section 15-9-710.

Based on these facts, the undersigned hereby moves for an Order of Publication in this matter in The Pickens County Courier, a newspaper having general circulation in Pickens County, to be published as required by law.

NOTICE OF SALE

PURSUANT to the terms of a Decree of Foreclosure and Sale by the undersigned Special Referee for Pickens County, South Carolina, dated February 7th, 2014, in the case  of Jesse E. Cobb, Plaintiff -vs- Harbor View of Keowee, LLC, Steve Cale, Harbor View of  Keowee Owner’s Association, Inc., f/k/a Harbor View of Keowee Condominiums Owner’s

Association, Inc., Defendants, I will sell at public outcry at the Courthouse for Pickens County, South Carolina, on March 3, 2014, during the usual hours of public sale to the highest bidder for cash the following described real estate:

ALL that certain piece, parcel or unit of land, situate, lying and being in the County of Pickens, State of South Carolina, and being known as Unit Number 312-C of Harbor View of Keowee Condominiums Horizontal Property Regime, established pursuant to Title 27, Chapter 31, code of Laws of South Carolina, as amended, pursuant to that certain Master Deed for Harbor View of Keowee Condominiums Horizontal Property Regime, dated December 19, 2006, and recorded December 21, 2006 in the office of the Register of Deeds for Pickens County, South Carolina in Book 1061 at page 40, with appended By-Laws and Exhibits including plat and architectural plans.  The Master Deed is incorporated herein and by this reference made a part thereof.  Reference is also made to that certain plat entitled “Survey of Harbor View of Keowee, LLC”, prepared by Ray Dunn, Land Surveyor, PLS#19400, dated December 2, 2004, revised November 21, 2006 and recorded in Plat Book 567 at page 19 and 20 in the aforesaid Register of Deeds Office of Pickens County, South Carolina.

This is the same property conveyed unto Harbor View of Keowee, LLC, by deed of Rufus Revis dated June 15, 2005, and recorded in the RMC for Pickens County, South Carolina on June 20, 2005 in Deed book 913 at page 253.

The property shall be sold for cash to the highest bidder.  The highest  bidder, other than the Plaintiff, shall be required, at the conclusion of the bidding, to deposit five (5%) per cent of the bid with the Special Referee in cash or equivalent as evidence of good faith; said deposit to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to Plaintiff’s debt in the case of non-compliance.

If the highest bidder fails or refuses to make the required deposit at the time or the bid or to comply with the other terms of the sale within twenty (20) days from the date of sale, then the Special Referee shall resell the property at the risk and expense of the defaulting bidder upon the same terms as above set out.  Purchaser shall pay extra for the preparation of the Special Referee’s Deed, for documentary stamps on the deed, recording of the deed and interest on the amount of the bid from the date of sale to the date of compliance with the bid at the rate of Ten (10.0%) percent, as  designated in the Decree.  The sale shall be subject to Assessments, Taxes due on the day of sale, Existing Easements, Easements and Restrictions of Record and other senior encumbrances.

Since personal or deficiency judgment being waived, the bidding will not remain open after the date of sale, but compliance with the bid may be made immediately.
