PUBLIC NOTICE

IN RE: Notice of Intention To File Petition To Close Road Under Section 57-9-10, Code of Laws of South Carolina(1976) as amended.

Notice is hereby given that the Town of Central intends to file a Petition to the Court of

Common Pleas, Thirteenth Judicial Circuit, Pickens County, S. C. to close a portion of a Pickens County Road or Street known as Folger Street. Such filing shall be made on a date after the third publication of this notice. This notice is to be published once a week, for three weeks, in The Pickens County Courier.

The portion of the road or street which is sought to be closed is described as follows:

PARCEL #1.

Allthat certain piece, parcel or lot of land lying, situate and being in the State of South Carolina, County of Pickens, within the corporate limits of the Town of Central and being shown and designated as 0.122 acre, 5,323 square feet, more or less, on a Survey of “Folger Street Reduction” by William C. Hutchins, P.L.S. 29117 dated November 23, 2015,and having, according to said plat the following courses, distances, metes and bounds, to-wit:

“BEGINNING at the intersection of Pepper Street and Mill Avenue and on intersection of the property now known as Folger Street, common corner of property of Cannon Memorial Baptist Church and running thence along Mill Avenue S43-20-16E 30.04 feet, thence turning and running along property of Cannon Memorial Baptist Church and common line with the property known as Folger Street S43-51-04W 107.41 feet to a computed point, thence continuing along property of Cannon Memorial Baptist Church and common line with the property now known as Folger Street S49-22-14W Lc=72.66 feet (A=72.77 feet)to a point on line of property of Cannon Memorial Baptist Church, thence turning and running along common line with Parcel 2. described herein below N38-42-52W 30.01 feet (crossing the property now known as Folger Street) to a point on line of Cannon Memorial Baptist Church, thence turn and running along line of Cannon Memorial Baptist Church and the property now known as Folger Street N49-16-18E Lc=65.69 feet (A=65.79 feet)to a computed point, on line of property of Cannon Memorial Baptist Church and property now known as Folger Street, thence continuing along line of Cannon Memorial Baptist Church and property now known as Folger Street N43-51-04E 108.89 feet to the point of BEGINNING.”

Allthat certain piece, parcel or lot of land lying, situate and being in the State of South Carolina, County of Pickens, within the corporate limits of the Town of Central and being shown and designated as 0.208 acre, 9,071 square feet, more or less, on a Survey of “Folger Street Reduction” by William C. Hutchins, P.L.S. 29117 dated November 23, 2015,and having, according to said plat the following courses, distances, metes and bounds, to-wit:

“BEGINNING at the common corner with Parcel 1. described herein above and running S38-42-52E 30.01 feet (crossing the property now known as Folger Street) to a point, common corner with property of Cannon Memorial Baptist Church and running thence S59-16-00W Lc=57.63 feet (A=57.66 feet) along property of Cannon Memorial Baptist Church and common line with the property now known as Folger Street to a point on line of property of Cannon Memorial Baptist Church, thence continuing along property of Cannon Memorial Baptist Church and then Joel Keith Abercrombie and common line with the property now known as Folger Street S61-40-58W 244.53 feet to a point on line of property of Joel Keith Abercrombie, thence turning and crossing the property now known as Folger Street N32-47-33W 30.09 feet to a point on line of property of City of Central, thence turning and running along line of property of City of Central and the property now known as Folger Street N61-40-58E 246.50 feet to a point on line of property of City of Central and the property now known as Folger Street, thence continuing along line of property of City of Central and the property now known as Folger Street N59-72-33E Lc=54.75 feet (A=54.61 feet) to the point of BEGINNING.”

NOTICE OF HEARING

ON PROPOSED SETTLEMENT

To creditors and shareholders, and their successors, and other persons interested in the Estate of Yellow Poplar Lumber Company (“Yellow Poplar”):

There is pending in the U.S. District Court for the Western District of Virginia a civil action styled Weyerhaeuser Company, et al v. Yellow Poplar Lumber Company, Inc., et al, Case No. 1:13CV00062, and a bankruptcy proceeding styled In re Yellow Poplar Lumber Company, Case No. 1:15CV00037.

Yellow Poplar was incorporated in Illinois and owned property in Buchanan and Dickenson Counties in Virginia. Yellow Poplar was adjudicated bankrupt in 1928 in the U.S. District Court in South Carolina, and the case was closed in 1930. In 2015, the bankruptcy case was reopened and transferred to Virginia.

In the bankruptcy case, the following creditors had unsatisfied claims: Iron City Savings Bank; Willie Johnson; Norfolk & Western Railway Co.; National Lumber Manufacturers Credit Ass’n.; Daniel W. Von Bremen; C. T. Venable; Union Sulphur Co.; White Oak Lumber Co.; and T. L. Zimmerman

Notice is hereby given that the Trustee of the Estate of Yellow Poplar (“Trustee”) has moved the Court to approve a proposed settlement involving competing claims to the gas estate on property in Buchanan and Dickenson Counties, Virginia, described as Tracts 4 and 11 in a deed dated January 5, 1906, to Yellow Poplar from Excelsior Coal and Lumber Corporation, recorded in Buchanan County, Virginia, Deed Book 30, page 226, and Dickenson County, Virginia, Deed Book 25, page 476 (“Property”). The proposed settlement involves (1) a division of ownership of the gas estate on the Property, (2) a division of royalties from past production of gas on the Property, which royalties are now in an escrow account of the Virginia Department of Mines, Minerals & Energy, (3) a division of future royalties from production of gas on the Property, and (4) the release and dismissal of claims involving the Property. Under the proposed settlement, the Trustee would receive a 67% ownership interest in the gas estate on Tract 4 and a 50% ownership interest in the gas estate on Tract 11. The royalties generated from past and future production would be divided on these same percentages. The rights of the creditors and shareholders or their successors in interest may be affected. If you do not want the Court to grant the motion, or if you want the Court to consider your views on the motion, then on or before May 5, 2017, you or your attorney must file with the Court a written objection.
