Pursuant to a decree entered in the case of Branch Banking and Trust Company v. Jimmy P. Stathos and Julie Stathos, the undersigned Special Referee will sell at public auction to the highest bidder at the back door of the Pickens County Courthouse, Pickens, South Carolina, on Monday, August 6, 2018 at 11:00 a.m. the following property:

ALL that certain piece, parcel or lot of land situate, lying and being in the State of South Carolina, County of Pickens, South of the City of Easley and on the south side of Sheriff Mill Road and according to a plat by Charles K. Dunn and Dean C. Edens, dated October 21, 1975 said lot is designated as Lot No. 1 contains .26 acres, more or less, and is more particularly described as follows, to-wit:

BEGINNING at a point in the center [of] Sheriff Mill Road at the northwest corner; thence South 21-01 East 66.4 feet to a point in the center of the old road bed; thence South 85-14 East 137.3 feet to an iron pin; thence North 15-33 East 105.6 feet to a point in the center of Sheriff Mill Road; thence along the center of the road South 77-54 West 105.3 feet to a point, the BEGINNING corner.

ALSO: ALL that certain piece, parcel or lot of land situate, lying and being in the State of South Carolina, County of Pickens, South of the City of Easley, on the south side of the above described lot, and according to a plat of Charles K. Dunn and T. Craig Keith Associates, Surveyors, dated June 17, 1977, said lot contains .19 acres, more or less, and is more particularly described as follows, to-wit:

BEGINNING at a point in the center of the old road bed, at the northwest corner; thence along the center of the old road bed, at the northwest corner; thence along the center of the old road bed South 85-25 East 136.5 feet to an iron pin on line now or formerly of Barbrey; thence South 14-50 East 24.75 feet to an iron pin; thence South 79-36 West 49.3 feet to a point; thence South 14-35 East 39.0 feet to an iron pin online of Bruce Sheriff; thence South 74-13 West 68.8 feet to an iron pin; thence North 20-31 West 107.0 feet to an iron pin, the BEGINNING corner.

This being the identical property conveyed to the mortgagor herein, Jimmy P. Stathos, by deed of Shelia S. Fuller, recorded January 4, 2011 in Deed Book 1368 at Page 75, records of Pickens County, South Carolina.

Terms of sale – For cash; purchaser to pay for deed and stamps, as applicable. The property will be sold subject to any past due or accruing property taxes, assessments, existing easements and restrictions of record. The deed to be delivered to the successful purchaser will contain no warranty of title; prospective bidders are advised to examine the public records to determine the status of the title. Each successful bidder other than Plaintiff will be required to deposit with the Special Referee as evidence of good faith five percent (5%) of bid in cash or certified check at time bid is accepted. Interest shall be paid on the bids through the date of compliance at a rate of 6.25%. In event purchaser fails or refuses to comply with terms of sale within 20 days from the close of bidding, deposit shall be forfeited and applied first to costs and then to Plaintiff’s debt, and the property shall be re-advertised and resold upon the same terms on some subsequent sales day at the risk of former purchaser until obtaining full compliance with sale.

As a deficiency judgment has been waived, the bidding will be final on Sales Day.
