LIS PENDENS

NOTICE IS HEREBY GIVEN that an action has been commenced and is now pending with regards to real property located in Pickens County, South Carolina owned by Plaintiff. The real property is described as follows:
ALL that tract or parcel of land in the County of Pickens, State of South Carolina, shown and designated as 4.47 acres, more or less, on plat entitled “Plat Prepared for Martha D. Garrens”, dated November 23, 1987, made by Michael L. Henderson, RLS, and recorded in Plat Book 33 at Page 49A. For a more full and particular description, reference is hereby specifically made to the aforesaid plat.

ALSO: A 30-foot easement for ingress and egress from Garvin Road to the above-described over the northwestern portion of that 2.98 acre tract shown on the above-referenced plat. BY VIRTUE of a decree heretofore granted in the case of: NCP Miami LLC (Assignee from RREF II CER CO Acquisitions LLC) vs. Kathy Neaves, individually and as Personal Representative of the Estate of Larry A. Allen, deceased; Patricia Allen Phelps; David Patrick Allen; T.D. Bank, N.A., successor by merger to Carolina First Bank; Lynn Adcox; Lorie Turner; John Doe and Richard Roe, as Representatives of all heirs and devisees of Larry A.
