NOTICE OF FILING COMPLAINT; TO THE DEFENDANTS ABOVE NAMED: YOU WILL PLEASE TAKE NOTICE that the original Complaint in the above entitled action was filed in the Office of the Clerk of Court for Pickens County on June 20, 2023.
ORDER APPOINTING GUARDIAN AD LITEM AND ATTORNEY: This matter is before the Court on the Motion for Appointment of Guardian Ad Litem and Attorney (the “Motion”) filed on behalf the above-named Plaintiff. Upon review of the Motion and the record in this matter, it appears that the Motion is well taken. Accordingly, the Motion is granted; and it is ORDERED that pursuant to SCRCP 17(c), Kelley Woody, P.O. Box 6432, Columbia, SC 29260, phone (803) 787-9678, is hereby appointed as Guardian Ad Litem (the “Guardian Ad Litem”) on behalf of all unknown persons who are minors and/or persons under a legal disability (the “Unknown Minors”) that have or may claim to have some interest in or claim to the real property in Pickens County, South Carolina, which is the subject of the above captioned foreclosure action (the “Property”); and it is FURTHER ORDERED that pursuant to the Servicemember’s Civil Relief Act of 2003, Kelley Woody is hereby appointed as attorney (the “Attorney”) on behalf of all unknown persons who may be in the military service of the United States of America (the “Unknown Military”) that have or may claim to have some interest in or claim to the Property; and it is FURTHER ORDERED that the Guardian Ad Litem and Attorney is empowered and directed to appear on behalf of and to represent the Unknown Minors and the Unknown Military, unless or until the they, or someone on their behalf, should, within thirty (30) days after service as hereinafter ordered, appear on their own behalf, or procure the appointment of a substitute or replacement Guardian, Guardian Ad Litem, and/or Attorney; and it is FURTHER ORDERED that Plaintiff’s counsel shall serve a copy of this Order, together with the Summons in this action, on the above-named Guardian Ad Litem and Attorney pursuant to SCRCP 4; and it is FURTHER ORDERED that Plaintiff’s counsel shall publish a copy of this Order, together with the Summons in the above captioned action, once a week for three (3) consecutive weeks in Greenville News, a newspaper of general circulation in the Pickens County, South Carolina.
