THE PLAINTIFFS complaining of the Defendant would respectfully show unto the Court as follows:

GENERAL ALLEGATIONS
1. That the Plaintiffs are citizens and residents of Greenville County, South Carolina.
2. That upon information and belief, the Defendant, Jacob Seth Sloan, is a citizen and resident of Pickens County, South Carolina.
3. That the collision which is the subject of this lawsuit occurred in Greenville County, South Carolina.
4. That on or about October 7, 2020, Plaintiffs were passengers in a vehicle stopped for traffic on Hwy 276 facing east in Travelers Rest, SC, when the Defendant, also traveling east on US-276 and negligently traveling too fast for conditions, suddenly and without warning forcefully struck the rear of Plaintiffs’ vehicle. Upon impact, the Plaintiffs were hurled about within the interior of the motor vehicle causing them to suffer serious injuries which will be fully described herein.
5. That the injuries and damages sustained by the Plaintiffs was due to and caused by and were the direct and proximate result of the negligent and/or reckless, willful, and wanton acts of the Defendant in one or more of the following particulars, to wit:
(a) In neglecting to yield the right of way to Plaintiffs;
(b) In colliding with the Plaintiffs’ vehicle;
(c) In choosing not to keep a proper lookout for traffic in general and in particular, the Plaintiffs;
(d) In choosing not to apply brakes timely so as to avoid crashing with the vehicle being driven by Plaintiffs;
(e) In evidencing an utter disregard for the safety of the public in general and in particular, the Plaintiffs;
(f) In choosing not to use that degree of care that an ordinary and prudent person would have used under the same or similar circumstances;
(g) In failing to take advantage of any last clear chance to avoid colliding with the Plaintiffs’ vehicle;

6. That as a direct and proximate result of the negligent and/or reckless, willful, and wanton acts of the Defendant, Plaintiffs have suffered serious painful and personal injuries. That as a result of their injuries, the Plaintiffs have been forced to undergo medical treatment and have incurred medical expenses. That as a result of the Plaintiffs’ injuries, they have been unable to engage in their normal pursuit of happiness, have suffered emotional distress and mental anguish, and have suffered economic losses, all to their great damage.

WHEREFORE, the Plaintiffs pray for judgment against the Defendant as follows:
A. For actual damages found to be just and equitable within the discretion of the fact finder;
B. For punitive damages if proven by clear and convincing evidence;
C. For the costs and disbursements of this action;
D. For prejudgment interest at the rate authorized by the South Carolina Supreme Court and S.C. Code Ann. Sec. 34-31-20 (B); and
E. For such other and further relief as this Court may deem just and proper.

MASTER IN EQUITY’S SALE

BY VIRTUE of a decree heretofore granted in the case of South Carolina State Housing Finance and Development Authority against Jacob Crenshaw and Rebekah Alicia Bailey et al., I, the Master in Equity for Pickens County, will sell on Monday, October 2, 2023, at 11:00 o’clock a.m., at the Pickens County Courthouse, Pickens, South Carolina, to the highest bidder:
All that certain piece, parcel or lot of land with any improvements thereto, situate, lying and being in the State of South Carolina, County of Pickens, being shown and designated as Lot 84, con-taining 0.60 acres, more or less, on a plat Revision of Lots 39, 40, 45 & 46 Golden Springs Phase II, prepared by Ray Dunn, PLS #19400, dated March 2, 2000 and recorded on March 6, 2000 in Plat Book 377 at Page 9A, records of Pickens County, South Caro-lina. Reference being hereby given for a more complete metes and bounds description.
This being the same property conveyed to Jacob Crenshaw and Rebekah Alicia Bailey, as joint tenants, with the right of survivorship and not as tenants in common, by deed of Kristen N. Merritt fka Kristen Nichols and Jonathan Ryan Merritt dated February 14, 2020 and recorded February 19, 2020 in the Office of the Register of Deeds for Pickens County, South Carolina in Book 2136 at Page 82.

TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Master in Equity for Pickens County at conclusion of the bidding, five percent (5%) of the bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of non-compliance. If the Plaintiff’s representative is not in attendance at the scheduled time of the sale, the sale shall be canceled and the property sold on some subsequent sales day after due advertisement. Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, the deposit shall be forfeited and the Master in Equity for Pickens County may re-sell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder). As a deficiency judgment is being Waived, the bidding will not remain open thirty days after the date of sale. Purchaser shall pay for preparation of deed, documentary stamps on the deed, and recording of the deed. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the rate of 3.875% per annum. The sale shall be subject to assessments, Pickens County taxes, easements, easements and restrictions of record, and other senior encumbrances.
