AMENDED NOTICE OF SALE
BY VIRTUE OF A DECREE of the Court of Common Pleas for Pickens County in the case of United Community Bank, a South Carolina state-chartered bank, Plaintiff, vs. GRAB LLC, Shelby Pharmacy LLC d/b/a Easley Health Mart Pharmacy, Jerry Shelby III, and Katura Shelby, under Case No. 2024-CP-39-01064, I, the undersigned, Master in Equity for Pickens County, will offer for sale at public outcry at 11:00 A.M., on Monday, July 7, 2025, at the Pickens County Courthouse, 214 E Main Street, Pickens, SC, the following described real property, to-wit:
All that certain piece, parcel or lot of land situate, lying and being in the State of South Carolina, County of Pickens, and according to a plat by Beeson Engineering Company dated February 13, 1996, said tract is known and identified as Tract B, containing (0.53) acres, more or less, as shown in Plat Book 223 at Page 15 and is more particularly described as follows, to-wit: Beginning at a point at the intersection of Fleetwood Drive and Hillcrest Drive, thence along Fleetwood drive South 53-45 West 222.57 feet to a point on the Road; thence leaving the road and running North 02-40 West 150.0 feet to a point; thence along Hillcrest East 175.0 feet to a point in Hillcrest Drive; thence along Hillcrest Drive South 20-12 East 104.1 feet to a point in the intersection of Fleetwood Drive and Hillcrest Drive, the point of Beginning. ALSO: A common easement for ingress and egress and parking on, about, and over that parcel of land identified as Tract “A” shall be used in common by the owners of, and for the benefit of Tracts “B,” “C,” “D,” E,” “F,” and “G.” ALSO: That certain Temporary Construction Easement, Permanent cross Easement For Ingress, Egress, Storm Water Flow and Parking dated December 8, 2015 and recorded January 14, 2016 in the Office of the Register of Deeds for Pickens County, South Carolina in Book 1740 at Page 225. This being the same property conveyed to GRAB, LLC by deed of JBK Real Estate, LLC dated November 19, 2015 and recorded December 2, 2015 in the Office of the Register of Deeds for Pickens County, South Carolina in Book 1730 at Page 252. TMS# 5019-11-66-8727. Address: 401 Hillcrest Drive, Easley, SC 29640.
TERMS OF SALE: For Cash: the purchaser shall be required to deposit the sum of five (5%) percent of the amount of bid (in cash or equivalent) as earnest money and as evidence of good faith. If the Plaintiff is the successful bidder at the sale, the Plaintiff may, after paying the costs of the sale, apply the debt due upon its Mortgage against its bid in lieu of cash. Should the person making the highest bid at the sale fail to comply with the terms of his bid by depositing the said five (5%) percent in cash, then the property shall be sold at the risk of such bidder on the same sales date or some subsequent date as the Master in Equity may find convenient and advantageous. Should the last and highest bidder fail to comply with the terms of his bid within thirty (30) days of the final acceptance of his bid, then the Master in Equity or his designated representative shall re-advertise and resell the property on the same terms on a subsequent date at the risk of such bidder. The purchaser to pay for documentary stamps on deed. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the interest rates contained in the Order. $262.42, per diem.
Note: As a Deficiency Judgment was granted, the bidding shall remain open for a period of thirty (30) days after the date of the sale as provided by law in such cases and compliance with the bid shall be made within thirty (30) days after the second sale. Plaintiff reserves the right to waive deficiency prior to the sale.
Note: If the Plaintiff or the Plaintiff’s representative does not appear at the scheduled sale of the above-referenced property, then the sale of the property will be null, void and of no force and effect. In such event, the sale will be rescheduled for the next available sales day.
Note: This sale is also made subject to all Pickens County taxes and existing easements and restrictions of record.
