BY VIRTUE OF AN ORDER of the Court of Common Pleas for Pickens County, South Carolina, heretofore issued in the case of Billy J. Bolding, the undersigned as Special Referee, R. Murray Hughes, will sell on April 6, 2015 at 11:00 a.m. at the Pickens County Courthouse in Pickens, South Carolina, to the highest bidder:

TERMS OF SALE: For cash. The purchaser(s) shall pay for deed and documentary recording fees and the successful bidder shall deposit with Clerk of Court for Pickens County a certified check or cash in the amount equal to 5% of the amount of the bid as evidence of good faith. Deficiency judgment being waived, the sale will not remain open and shall be final on the said sales day. In the event the successful bidder fails to comply with the terms of sale within 20 days the deposit will be applied to the cost and the balance distributed to the Plaintiff and the Special Referee shall forthwith resale the property, after due notice and advertisement, at such subsequent sales day until a purchaser who shall comply with the terms of sale is obtained. YOU WILL PLEASE TAKE NOTICE that pursuant to an Order of Kenneth D. Acker, Special Referee for Pickens County, issued in the above captioned case, the Special Referee for Pickens County will sell at public auction to the highest bidder for cash at or before the Courthouse in Pickens, South Carolina, at 11:00 o’clock a.m., Sales Day in April, the same being April 6, 2015, the following described tract of land located in Pickens County, South Carolina:

ALL that certain piece, parcel or lot of land lying and located being situate in the State of South Carolina, County of Pickens, in Liberty Township, being bounded on the North and West by paved roads and on the East and South by other lands of J. D. Holliday and being more particularly described according to plat prepared by John C. Smith, Surveyor, dated August 2, 1961, as follows, to-wit:

BEGINNING at a nail in center of paved road, the Northeastern corner of the lot herein described, thence leaving road South 31-18 West 173.9 feet to an iron pin; thence North 60-15 West 200 feet, crossing iron pin, to a nail in center of road; thence with center of road North 41-00 East 100 feet to a nail in center of intersection of roads; thence South 82-30 East 200 feet with center of road to point of BEGINNING, the being the identical property conveyed to Brenda Walker Young by Doris Ray Holliday by deed of November 26, 1980 to be recorded.

This being a portion of the property conveyed unto Robert E. Dye, Jr. by deed of Brenda Dye Real Estate, LLC dated October 9, 2013, and recorded October 10, 2013, in Deed Book 1558 at Page 100, Pickens County records. See Contract for Sale between Brenda W. Young (Real Estate, LLC) and Desmond Smith, III and Erica Z. Smith dated March 7, 1996, and recorded February 12, 2010, in Deed Book 1302 at Page 202, Pickens County records. Contract was assigned to Robert E. Dye, Jr. on October 13, 2013, and recorded October 31, 2013, in Book 1561 at Page 325, Pickens County records.

The terms shall be for cash and the purchaser, or purchasers, shall pay for the deed and stamps. In the event the agent of Plaintiff does not appear at the time of sale, the within property shall be automatically withdrawn from sale and sold at the next available sales date upon the same terms and conditions as set forth in the Decree. The bidding will not remain open after the date of sale, but compliance with the bid may be made immediately. The successful bidder shall deposit with the Special Referee a certified check or cash in the amount of five (5%) percent of the bid as evidence of good faith. In the event the purchaser fails or refuses to comply with the terms of the sale within twenty (20) days from the date of sale, the deposit shall be forfeited and applied first to the costs and expenses of this action including fee for the Plaintiff’s attorney. Next, any surplus will be held pending further Order of the Court. I shall then re-advertise and re-sell the property upon the same terms on a subsequent Sales Day at the risk of the former purchaser until obtaining full compliance with a sale. The successful bidder other than the Plaintiff will pay interest on the amount of the bid from the date of sale to the date of compliance at the rate of $9.47 a day.

The sale shall be subject to taxes and assessments, to existing easements and restrictions, and to any other senior encumbrances. ALSO, sold subject to the 120 day right of redemption of the Defendant, United States of America, Internal Revenue Service.
