TO THE DEFENDANT, CASS CASTO:

YOU ARE HEREBY SUMMONED AND REQUIRED to apply to the Clerk of this Court for a copy of the Summons and Complaint filed in this matter on January 13, 2015 and to Answer the Complaint and serve a copy of your Answer upon the undersigned at his office at 603 W. Main St., Walhalla, SC 29691, or at PO Box 400 Walhalla, SC 29691, within thirty (30) days after service hereof upon you, exclusive of the day of such service, and if you fail to answer the Complaint within that time, Judgment against you will be rendered by default for the relief sough therein.

This being the Summons and Complaint filed in this Quiet Title action regarding the following property:

“All that certain piece, parcel or lot of land lying and being situate in the State of South Carolina, County of Pickens, and being known and designated as Lot 39 in the Woodside Mill Subdivision as shown on plat of Robert R. Spearman, Reg. L. S. No. 3615, dated September 13, 1982, reference to which is hereby made for a more complete and accurate description, and being thereon more fully described according to said plat as follows, to-wit:

“BEGINNING at a point on Second Street, which point is into asphalt drive dividing Lot No. 40 and Lot No. 39; thence running along Second Street S28-04E 57.21 feet to a point on edge of street; thence S15-53W 35.46 feet to a point on Second Street; thence continuing along Second Street S62-26W 83.54 feet to a point in center of 12’ alley; thence running along center of alley N31-00W 76.50 feet to a point in center of alley; thence leaving alley and running along property of Lot No. 40 in a northeasterly direction N58-04E 112.20 feet to the point of BEGINNING, and being bounded on the northeast, east, and southeast by Second Street; bounded on the southwest by the 12’ alley; and bounded on the northwest by Lot No. 40.”

THIS BEING THE SAME PROPERTY conveyed to Cass Castro by deed from Neal Lane Properties, LLC by deed dated October 3, 2007, and recorded in the Register of Deeds Office for Pickens County on October 9, 2007 in Book 1140 at Page 43.

TO INFANTS UNDER EIGHTEEN YEARS OF AGE, IMPRISONED PERSONS AND INCOMPETENT PERSONS:

YOU ARE FURTHER SUMMONED and notified to apply for the appointment of a guardian ad Litem to represent you in this action within THIRTY (30) DAYS after the service of the Summons upon you. If you fail to do so, applications for such appointment will be made by the Petitioner herein.

YOU ARE FUTHER ADVISED of your right to have an attorney represent you in this matter. Should you retain legal counsel, (s)he is directed to advise the Court of such representation, forthwith.

NOTICE OF SALE

BY VIRTUE OF A DECREE of the Court of Common Pleas for Pickens County in the case of Cantey Mortgage Company Inc., vs. William Calvin Gilbert, under Case No. 2014-CP-39-112, I, the undersigned as Special Referee for Pickens County, will off for sale at public outcry at 11:00 AM Monday, May 4, 2015 at Pickens County Court House, 214 E Main Street, Pickens SC 29671, the following described real property to wit:

All that certain piece, parcel or tract of land situate, lying and being in the State of South Carolina, County of Pickens, being show and designated as Lot 84 of West Bagwell Road Estates, according to a plat recorded in Plat Book 69 at pages 141 through 144 in the office of the Register of deeds for Pickens County, South Carolina, reference to which is herby craved for a more complete and accurate description.

THERMS OF SALE: For Cash: the purchaser shall be required to deposit the sum of five (5%) percent of the amount of bid (in cash or equivalent) as earnest money and as evidence of good faith. If the Plaintiff is the successful bidder at the sale, the Plaintiff may, after paying the costs of the sale, apply the debt due upon its Mortgage against its bid in lieu of cash. Should the person making the highest bid at the sale fail to comply with the terms of his bid by depositing the said five (5%) percent in cash, then the property shall be sold at the risk of such bidder on the same sales date or some subsequent date as the Special Referee may find convenient and advantageous. Should the last and highest bidder fail to comply with the terms of his bid within thirty (30) days of the final acceptance of his bid, then the Special Referee or his designated representative shall re-advertise and resell the property on the same terms on a subsequent date at the risk of such bidder. The purchaser is to pay for documentary stamps on deed. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the interest rates contained in the Order.

Note: If the Plaintiff or the Plaintiff’s representative does not appear at the scheduled sale of the above-referenced property, then the sale of the property will be null, void and of no force and effect. In such event, the sale will be rescheduled for the next available sales day.

Note: This sale is also made subject to all Pickens County taxes and existing easements and restrictions of record.
