NOTICE IS HEREBY GIVEN by the County Council of Pickens County, South Carolina (the “County Council”) that the County Council will conduct a public hearing on the proposed enactment of an Ordinance entitled:

“AN ORDINANCE TO DEVELOP A JOINTLY OWNED AND OPERATED INDUSTRIAL/BUSINESS PARK IN CONJUNCTION WITH OCONEE COUNTY, SUCH INDUSTRIAL/BUSINESS PARK TO BE GEOGRAPHICALLY LOCATED IN OCONEE COUNTY AND ESTABLISHED PURSUANT TO SECTION 4-1-170 OF THE CODE OF LAWS OF SOUTH CAROLINA, 1976, AS AMENDED; TO PROVIDE FOR A WRITTEN AGREEMENT WITH OCONEE COUNTY TO PROVIDE FOR THE EXPENSES OF THE PARK, THE PERCENTAGE OF REVENUE APPLICATION, AND THE DISTRIBUTION OF FEES IN LIEU OF AD VALOREM TAXATION; AND OTHER MATTERS RELATED THERETO (PROJECT RUBY SLIPPER).”

Subject to the normal rules of County Council regarding appearances, members of the public are invited to attend and make comment concerning the proposed Ordinance. The public hearing will be held on January 3, 2022 at 6:30 p.m. in the Chambers of County Council, which are located at Pickens County Administration Facility, 222 McDaniel Avenue, Pickens, South Carolina 29671.

NOTICE OF SALE
Case No. 2021-CP-39-00052

BY VIRTUE of a decree heretofore granted in the case of Estate of Billy L. Hicks and Cindy P. Hicks v. Zachary Derrick, Nikki Derrick, 1st Franklin Financial, Credit Central, and RMC Financial Services, Case No. 2021-CP-39-00052, I, the undersigned Special Referee, or my Designee, for Pickens County, will sell on January 3, 2022, at 11:00 a.m. at the Pickens County Courthouse in Pickens, SC, to the highest bidder, the following described property, to-wit:

ALL that certain piece, parcel or lot of land, situate, lying and being in the State of South Carolina, County of Pickens, being shown and designated as Lot 50, on Plat entitled “Long Creek Acres”, prepared by Robert R. Spearman, R.L.S # 3615, dated December, 1973 and recorded in Plat Book 19 at page 541, in the Register of Deeds Office for Pickens County, South Carolina. Reference being hereby given for a more complete metes and bounds description thereof.”

This being the same property conveyed unto Zachary Derrick and Nikki Derrick by deed from Billy L. Hicks and Cindy P. Hicks dated February 25, 2009, and recorded on March 6, 2009, in Deed Book 1241 at Page 66, in the Register of Deeds Office for Pickens County, South Carolina.

This conveyance is made subject to any and alt existing reservations, easements, rights of way, zoning ordinances, setback lines, and restrictions or protective covenants that may appear of record, on the recorded plat(s), or on the premises, of record, including matters shown on recorded plats.

TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Special Referee, or his Designee, at conclusion of the bidding, five percent (5%) of said bid, in cash or equivalent, as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to Plaintiff’s debt in the case of noncompliance. Should the successful bidder fail or refused to make the required deposit at time of bid or comply with the other terms of the bid within twenty (20) days, then the Special Referee or his Designee may resell the property on the same terms and conditions (at the risk of the said defaulting bidder). Should the Plaintiff, or one of its representatives, fail to be present at the time of sale, the property is automatically withdrawn from said sale and sold at the next available sales day upon the terms and conditions set forth in the Judgment of Foreclosure and Sale or any Supplemental Order. The successful bidder will be required to pay for documentary stamps on the deed and interests in the balance of the bid from the date of sale to the date of compliance with the bid at the rate of Five Percent (5%) per annum.

No personal or deficiency judgment being demanded, the bidding will not remain open after the date of sale, but compliance with the bid may be made immediately.

NOTICE: The foreclosure deed is not a warranty deed. Interested bidders should satisfy themselves as to the quality of title to be conveyed by obtaining an independent title search well before the foreclosure sales date.
